AMENDMENTS TO THE LAW «ON THE PROMOTION OF HOUSING CONSTRUCTION»

On the 3rd of December 2010 the chairman of the committee for housing construction and land affairs of the Russian State Duma Martin Shakkum introduced several amendments to the Federal law ¹ 161-FZ "On the promotion of housing construction" dated as of 24.07.2008, which regulates activities of the Russian Housing Development Foundation (RZHS). One of the reasons for this revision of the Russian legislation was tremendous public concern regarding the conveyance of lands belonging to the Pavlovsk experiment station of VIR and instruction given by the Russian President Dmitry Medvedev for this issue to be scrutinized. As Alexey Kalinin reports, the representative of the Co. Ltd “Biznes Resheniya”, adoption of these amendments set an important precedent in juridical practice and we may expect other offended owners will try to request their lands back.

The amendment says, RZHS may transfer lands according to the resolution of the Russian Government to the ownership of legal entities. The chairman of the committee reported, it will contribute to more effective implementation of the priority projects and programs, which play an important socio-economic role for the State.

At the present time this right applies according to the Russian legislation only to lands designated for a construction of objects related to social infrastructure (hospitals, schools, kindergartens). Thus, amendments introduced are establishing a mechanism of legal regulation for a possible transfer of lands (in case such a resolution is adopted) occupied by fruit, berry, ornamental and forage crops from RZHS to the ownership of the Pavlovsk station of VIR.

Administration of VIR and that of the Pavlovsk station are waiting for the Government resolution letting the transfer of a part of lands to the ownership of the Pavlovsk station.
